GAFA包囲網の進捗 米国を代表する4つの巨大IT企業「GAFA」への包囲網が着実に狭まっているーー。 米国下院議会の反トラスト小委員会は先頃、GAFAがデジタル市場における独占力を乱用して競争を歪めている、とする報告書を公表した。 野党民主党の議員を中心にまとめられた同報告書は、反トラスト法(独禁法)の改正など規制強化に加え、GAFAの企業分割にまで踏み込んだ内容となっている。 与党共和党の合意が得られていないため、現時点で実行に移される公算は低いが、来る11月の大統領選と上下両院選などの結果次第では、GAFAの独占力を削ぐための立法化が始まる可能性もある。 また、米メディアによれば、議会とは別に司法省がグーグルを、FTC(連邦取引委員会)がフェイスブックを各々、反トラスト法違反で提訴する準備を進めており、今回の議会報告書はそれに勢いを与えることになる、と報じている。 〔PHOTO〕Gettyimages 「企業分割」にまで踏み込む内容 下院司法委員会の反トラスト小委員会は過去1年4ヵ月に渡って、業界関係者からの聞き取り調査やGAFAの経営トップを召喚した公聴会を催す等して調査を続けてきた。 これを経てまとめられた今回の報告書は、現在のGAFAを19~20世紀の米国における石油会社や鉄道会社のような巨大独占企業に喩えている。 その上でGAFAが各々の業界内における独占的な地位を乱用し、商品の価格や業界のルールを自分たちに都合の良いように決めてきた、と指摘した。 また、自らのプラットフォーム上で自社製品を優遇したり、サードパーティ業者のデータを自社ブランド商品の開発や販売戦略に活用してきた点なども認め、新興企業のM&A(買収・合併)によって将来的な競争の芽を摘んでいる、とも指摘した。 これらを是正するために、報告書はGAFA各社のプラットフォームとその他の事業を分離するなど、事実上の「企業分割」を提案。また、反トラスト法を大幅に改正するなどして、GAFAのような巨大企業が小さな新興企業を買収することに強い規制を設けるべきだと提言した。   さらに今後、GAFAなど巨大企業がM&Aを実施する際には、それが競争を阻害しないことを規制当局ではなく企業自らが証明することも求めている。 Source:
